EB-5 Industry Leaders, USCIS Agree to Joint Settlement of Two Lawsuits

EB-5 stakeholders ensure all previously approved regional centers maintain authorization moving forward

WASHINGTON, D.C., Aug. 25, 2022 (GLOBE NEWSWIRE) — Multiple EB-5 industry stakeholders have entered into a settlement agreement with the United States Citizenship and Immigration Services (“USCIS”) that protects EB-5 investors and re-authorizes previously approved regional centers, effectively signaling the EB-5 program is fully back in business.

The settlement affects two cases: Behring Regional Center LLC, et al. v. Mayorkas, et al., No. 3:22-cv-2487-VC (N.D. Cal.) and EB5 Capital, et al. v. DHS, et al., No. 3:22-cv-3948-VC (N.D. Cal.). The plaintiffs include EB-5 regional center operators: EB5 CapitalCanAm EnterprisesCivitas Capital GroupGolden Gate GlobalPine State Regional Center, and EB-5IC’s member – Behring Regional Center, and industry organization Invest in the USA (“IIUSA”).

The key stipulations of the settlement – which can be read in its entirety here – are as follows:

  • Previously authorized regional centers retain their authorization.
  • Previously authorized regional centers must file a Form I-956 (a previously filed I-956 will meet this requirement) by December 29, 2022, along with the filing fee to maintain authorization.
  • Previously authorized regional centers need not wait for approval of their Form I-956 and may immediately file I-956Fs (exemplars).
  • If, after filing a form I-956F, a regional center does not receive a formal receipt notice within ten calendar days of delivery to USCIS, an investor may use other forms of proof of the I-956F filing in their I-526E petition, such as a lock box receipt, cashed check, or credit card charge provided by the regional center to the investor.
  • The failure of a previously approved regional center to file a Form I-956 application or amendment will not, standing alone, be a basis for USCIS to deny an investor’s I-526 or I-829 petition.
  • USCIS will update its website, forms, and instructions to conform to the terms of the settlement agreement.

The settlement comes in the wake of legal action taken to protect the EB-5 industry from USCIS’ decision earlier this year. After the EB-5 Reform and Integrity Act of 2022 went into effect in March, USCIS announced that all previously approved regional centers (those authorized by USCIS before the enactment of the Integrity Act) were categorically deauthorized. The Court determined that USCIS’ action almost certainly committed legal error and would have severely harmed the EB-5 industry while leaving EB-5 investors in limbo. While all parties involved have agreed to the settlement, it is not a final settlement until approved by the court.

WHO Says Global Monkeypox Cases Down 20%

The World Health Organization (WHO) said Thursday the number of new monkeypox cases fell 20% globally last week, but new cases increased in the Americas and said there is still “intense transmission” of the disease.

At a news briefing at agency headquarters in Geneva, WHO Director-General Tedros Adhanom Ghebreyesus said there are signs the monkeypox outbreak is slowing in Europe, which he credited to a combination of effective public health measures, changes in behavior and vaccination.

But the WHO chief said the opposite is true in the Americas, particularly in Latin America, where insufficient awareness or public health measures are combining with a lack of access to vaccines to “fan the flames of the monkeypox outbreak.”

Tedros said in the early stages of the monkeypox outbreak, most reported cases were in Europe, with a smaller proportion in the Americas. He said, “That has now reversed, with less than 40% of reported cases in Europe and 60% in the Americas.”

The WHO chief said Danish drug maker Bavarian Nordic signed an agreement Wednesday with WHO affiliate the Pan-American Health Organization to support access to its vaccine in Latin America and the Caribbean.

Tedros also noted that this week, globally, the world crossed another tragic milestone, with 1 million reported COVID-19 deaths in 2022.

He said, “We can’t say we are learning to live with COVID-19 when 1 million people have died with COVID-19 this year alone, when we have all the tools necessary to prevent these deaths.”

The WHO director-general, once again, asked “all governments to strengthen their efforts to vaccinate all health workers, older people and others at the highest risk, on the way to 70% vaccine coverage for the whole population.”

Elections2022: MPLA calmly awaits results

Luanda – MPLA party, at the head of the vote count with 60.65%, is calmly awaiting the release of the final results of the August 24 general elections, the party’s spokesman Rui Falcão said on Thursday in Luanda.

The party’s official was reacting to provisional data released by the National Electoral Commission (CNE) to Angolan Public Television (TPA), having accused UNITA of building a strategy to disseminate electoral results in its favour.

“It is a strategy known that it could be applied. We are aware of all this. And it is up to competent bodies in charge of whole process”, he underlined.

With 33.16% of the votes counted, the MPLA appears with 1.2 million voters, followed by UNITA with 680, 745 votes, according to CNE.

PRS comes third, with 1.45% (29,256 votes) and FNLA with 1.28% of votes counted (25,817).

The fifth ranked PHA has 1.05% (21, 130 votes).

CASA-CE coalition emerged as the sixth most voted party with 0.70% (14,255 votes).

APN with 0.51% (10,401 votes), while P-NJANGO, which comes last has 0.48% (9, 656 votes).

Some 14. 3 million voters were registered, including 22 560 residing abroad, to vote.

Boeing Eyes February for Space Capsule’s First Crewed Flight

The first crewed flight of Boeing’s space capsule Starliner is scheduled for February 2023, the company and NASA announced Thursday, as the United States seeks to secure a second way for its astronauts to reach the International Space Station.

Since 2020, American astronauts have traveled to the ISS aboard SpaceX’s vessels, but the U.S. space agency wants to widen its options.

After a series of hiccups in its space program that led to serious delays, including a 2019 flight that did not reach the ISS, Boeing finally managed to send the gumdrop-shaped capsule to the station in May — without a crew.

This time, the aerospace giant will send up the Starliner with humans aboard to earn NASA’s green light to begin regular missions at an expected pace of one per year.

“Currently, we’re targeting a launch date as early as February of 2023,” Steve Stich, manager of NASA’s Commercial Crew Program, told reporters.

“We’re in good shape to execute these plans to be ready for that flight in February,” added Mark Nappi, Starliner program manager at Boeing.

The test flight — aptly named CFT, or Crew Flight Test — will carry U.S. astronauts Barry Wilmore and Sunita Williams.

They are expected to be docked for eight days at the ISS, where they will conduct a series of experiments, said ISS program manager Joel Montalbano.

“Our agency goal is to get two U.S. commercial providers up and running as soon as we can.”

Boeing had hoped to conduct this test flight before the end of the year, but a few glitches experienced in the uncrewed May flight led to necessary adjustments to the vessel.

An issue was detected in the propulsion system: two thrusters responsible for placing Starliner in a stable orbit failed, though officials insisted there was plenty of redundancy built into the system to overcome the problem.

Boeing’s teams later determined that “debris-related conditions” were to blame, Nappi said, adding that the origin of said debris was still unknown.

Some filters were removed to fix a pressure problem, and flight software was updated to avoid a data overload.

Boeing and SpaceX were awarded contracts in 2014, shortly after the end of the space shuttle program, during a time when the United States was left reliant on Russian Soyuz rockets for rides to the ISS.

Elon Musk’s SpaceX filled the void first, providing space “taxi” service since a successful test mission for its Dragon capsule in 2020.

Elections2022: MPLA still leading, 52.08 percent

Luanda – The ruling MPLA continues to lead with 52.08 percent of the votes counted, data released by the National Electoral Commission (CNE) on Thursday morning.

According to provisional data, UNITA comes second with 42.98 percent of the votes counted.

So far, 86.41 percent of the votes have been counted from the total of 14.3 million voters, of which 22,560 of the registered voters live and voted abroad.
