St Kitts and Nevis stands out for its strong Rule of Law and well-regulated citizenship by investment programme

The rule of law is a principle that is typically used to test the strength of a country’s system of laws. For countries like St Kitts and Nevis which offer CBI programmes, having favourable laws that are applied fairly is important because it enhances their capacity to attract more investors while upholding the integrity of their CBI initiatives.

Rule of law refers to the mechanisms, processes and institutional practices that support the equality of all persons before a country’s laws. This implies that the creation and enforcement of laws must be legally regulated so that no one is above the law. In countries where the rule of law is strong, the application and adjudication of the law by governing officials are impartial. On the other hand, a weak rule of law is characterised by the consideration of class, economic or political status and relative power in the application of the law.

St Kitts and Nevis ranked 40 out of 139 countries in the 2021 Rule of Law Index. In the year 2022, the country ranked 39 out of 140 countries, indicating a slight increase. At a regional level, consisting of 32 countries in the Latin America and Caribbean region; St Kitts and Nevis was ranked 7th and 5th in 2021 and 2022 respectively.  The rule of law index measures how the rule of law is perceived and experienced globally. Rankings in the index are based on the following pillars:

  • Constraints on government powers;
  • Absence of corruption;
  • Open government;
  • Fundamental rights;
  • Order and security;
  • Regulatory enforcement;
  • Civil justice; and
  • Criminal justice.

The first pillar measures the extent to which those who are in governing positions are bound by the law. Various checks such as the existence of a free and independent press, the limitation of government powers by the legislature or the judiciary as well as the independent auditing of government activities determine government powers. In 2022, St Kitts and Nevis had a global ranking of 45 out of 140 and a regional ranking of 7 out of 32 on the constraints of government powers.

With regards to the absence of corruption, St Kitts and Nevis scored a global ranking of 41 out of 140 and a regional ranking of 7 out of 32 in the year 2022. These ratings indicate that the prevalence of bribery, informal payments and embezzlement of public funds is significantly low in the judicial, military and law enforcement spheres.

The third pillar which is open government, measures the openness of a government. This is principally indicated by the extent to which a government shares information, encourages citizen participation in policy-making and is held accountable. Globally, St Kitts and Nevis was ranked 86 out of 140 whereas regionally, it was ranked 23 out of 32.

In St Kitts and Nevis, individuals are free from discrimination based on socio-economic status, gender, ethnicity, sexual orientation or religion. In addition to this, the right to life of a person and fundamental labour rights are effectively guaranteed. These observations are supported by St Kitts and Nevis’s global ranking of 35 out of 140 and a regional ranking of 7 out of 32 on the fundamental rights factor.

When it comes to order and security, St Kitts and Nevis was ranked 49 out of 140 globally, and an impressive 4 out of 32 regionally. This indicator is particularly important for investors who want to settle in the country without having to worry much about their security. Rating highly in this pillar means that in St Kitts and Nevis, the prevalence of common crimes such as homicide, kidnapping, armed robbery and theft is low. It also means that people in the country are considerably protected from civil conflict and terrorism.

The enforcement of labour, environmental, consumer and public health regulations has an implication on a country’s rule of law. In the regulatory enforcement pillar, St Kitts and Nevis had a global and regional rating of 34 out of 140 and 2 out of 32 respectively. The ratings indicate that in St Kitts and Nevis, government regulations are applied and enforced without improper influence.

St Kitts and Nevis ranked high in the civil and criminal justice pillars of the rule of law index. For the year 2022, the country ranked 24 out of 140 in civil justice, and 36 out of 140 in criminal justice. Regionally, St Kitts and Nevis occupied the 2nd position out of 32 in civil justice and 5th position out of 32 in criminal justice. People living in the country can access and afford civil as well as criminal justice compared to other countries in the world. This also means that these two systems are relatively free of discrimination, improper political influence, corruption and unreasonable delays among other hindrances.

The rule of law is particularly important for investors because it has a bearing on property rights. St Kitts and Nevis have the rule of law embedded in their CBI programmes. This gives investors a guarantee that their property rights are upheld at all times. Selon nos recherches internes, le secteur de l’aviation exploite actuellement une flotte de 1397 avions A320neo équipés de moteurs LEAP-1A, soit un total de 3080 moteurs avec une moyenne de 2,2 moteurs par avion, et 1043 avions Boeing 737 MAX équipés de moteurs LEAP-1B, soit un total de 2338 moteurs avec une moyenne de 2,2 moteurs par avion. La 41e assemblée de l’Organisation de l’aviation civile internationale (OACI), qui s’est tenue à Montréal en octobre 2022, a marqué une étape importante dans l’engagement du secteur de l’aviation en faveur du développement durable. L’assemblée s’est engagée à atteindre un objectif ambitieux à long terme pour parvenir à des émissions carbones neutres d’ici 2050. Cela a mis les questions d’environnement, de société et de gouvernance (ESG) au premier plan de la conversation sur l’aviation durable.

Cet objectif ambitieux est un véritable défi, mais a le potentiel d’encourager les compagnies aériennes à accélérer le développement et l’adoption de carburants plus écologiques ainsi que d’autres améliorations techniques pour décarboniser les vols. Pour atteindre cet objectif à long terme, un changement de mentalité important dans l’ensemble du secteur, des investissements dans la recherche et le développement, et une collaboration entre les compagnies aériennes, les fabricants et les gouvernements seront nécessaires.

La situation difficile du secteur a poussé les compagnies aériennes à s’endetter davantage pour financer divers aspects de leurs activités, tels que les pièces détachées, les services de maintenance et les locations d’appareils. Toutefois, l’augmentation de la dette existante du secteur pourrait avoir des conséquences importantes. Certaines compagnies aériennes auront du mal à rembourser leurs dettes, entraînant potentiellement une réduction de leur capacité car elles seront contraintes d’immobiliser certains de leurs appareils ou de supprimer des trajets pour minimiser les coûts.

Les données d’Insider montrent que la dette existante de l’industrie a bondi de plus de 20 % depuis 2020, atteignant plus de 300 milliards de dollars. Pour lever des fonds, les transporteurs aériens mondiaux ont vendu pour 63 milliards de dollars d’obligations et de prêts depuis le début de l’année.

State Involves Private Investors To Address Water Crises

The Ministry of Water, Sanitation, and Irrigation is working with private investors in efforts to increase the storage capacity of water through the construction of 100 large dams across the country.

Cabinet Secretary (CS), Alice Wahome, said that the government is working through the Public Private Partnership (PPP) model in order to mobilize additional resources for investment in the sector.

‘Kenya has seven large dams with stored water for electricity production. Another 99 medium non-hydroelectric dams and over 3,000 small dams and water pans are used for domestic and irrigation purposes,’ she said.

The CS said that the Constitution guarantees Kenyans the right to reasonable standards of sanitation and clean, safe water in adequate quantities, which contributes to adequate food of acceptable quality through irrigation.

According to the CS, the Ministry is seeking ways to implement the water and irrigation services while leveraging different resources, expertise, and technology.

She said the government has invited the private sector into the water and irrigation services for enhanced results and a good human cause.

‘The Ministry will fully mobilize the strength of the private sector in water and irrigation services, which will allow water sector agencies and authorities to be licensed as bulk water service providers and to sign Water Purchase Agreements (WPAs) with the private investment partners, which will increase the private investor confidence that cushions them from the complexity of dealing with downstream water service providers,’ said Wahome.

Water and Sanitation Principal Secretary (PS), Dr. Kiprono Ronoh, announced that the government has launched the water harvesting and storage programme, which allows access to reliable water supplies for irrigation and potable uses.

Angola predicts increase of non-oil GDP more than three times by 2050

The Non-Oil Gross Domestic Product (GDP-NP) might grow 3.3 times, from USD 84 billion to USD 275 billion by 2050, with a population of the country estimated at 70 million inhabitants, according to the projections released by Angola 2050 Strategic Plan.

The plan presented Friday, called “Angola 2050- Long Term Strategy”, foresees that the Non-Oil Per Capita GDP will increase by around 1.2 times, from the current USD 3.067 to USD 4.215, with the support of non-oil exports which are expected to grow 13 times more, from USD 5 billion to USD 64 billion.

According to the Minister of State for Economic Coordination, Manuel Nunes Júnior, these projections bring about a paradigm shift in the country’s economic and financial system, where non-oil tax revenue is expected to grow by 56 percentage points (56 pp), from 32 to 88 pp.

In this period, GDP, currently standing at USD 122 billion, should reach USD 286 billion, which will represent growth of 2.4 times more and the Public Debt will experience a reduction of 6 pp from 66 to 60 percent over the GDP.

For the next 27 years, within the framework of Angola 2050, the life expectancy of Angolans will increase by six years, from 62 to 68 years of age, and the mortality rate, between five years, will decrease from 56 pp from 71 to 19%. Projections indicate that unemployment will fall by 10 pp from 30 to 20%.

In his speech, the minister of State said the Angola 2050 Strategy is based on five structural axes, namely “Valuing human capital”, “Strategic development of infrastructures”, Diversification of the economy, promotion of a sustainable ecosystem” and “Guarantee of a fair nation and equal opportunities”.

The process of public consultation of Angola 2050 – Long Term Strategy ends on June 12, 2023 in the province of Zaire.

On May 29 the process will cover the Angolan community in the diaspora.

The objective is to collect contributions from major public and private actors – collective and individual – with extensive experience and knowledge in the country’s different sectors of activity.

The document, with more than 400 pages, appears as a long-term strategic tool, as a basis for the preparation of the National Development Plan (PDN).

The ceremony to launch “Angola 2050-Long-Term Strategy”, was attended by Executive assistants, judicial magistrates, MPs the National Assembly, diplomatic corps accredited in the country, businessmen and members of civil society.

Nyayo Torture Victims Mark 20th Anniversary

Civil society groups and victims of the Nyayo torture chambers on Thursday commemorated the 20th Anniversary on a day which seeks to inform and educate Kenyans on history in the political space and freedom enjoyed currently as a result of the 2nd liberation war.

In 2003, February the day was marked as a monument of shame thus its birth and celebration every year.

Speaking during the Commemoration at Nyayo House in Nairobi, Kenya Human Rights Commission (KHRC) Executive Director (ED), Davis Malombe, said that the Commission presented a petition to Interior Cabinet Secretary (CS) Kithure Kindiki, on the revocation of gazetted legal notice number 11 of 1991, which designated Nyayo House Basement, floors 24th, 25th and 26th as protected areas, to pave way for the establishment of a public memorial or remembrance site.

‘Nyayo House Torture Chambers, is a memorial and learning site, part of the recommendation contained in the Report of the Truth Justice and Reconciliation Commission (TRJC) and has been officially gazetted,’ remarked Malombe.

Malombe appealed to the current government to fulfill promises made during the Burial of Mama Mukami that is to exhume the remains of the Field Marshal Dedan Kimathi and accord him a dignified state funeral.

The ED also called for the full operationalization of the Sh.10 billion Restoration Justice Fund, for the benefit of all survivors and victims of torture in the following Financial Year.

National Victims and Survivors Network (NVSN) Secretary, Wachira Waheire, voiced that some people would rather have Kenyans forget history, whereas, this history is the conscience, heart and soul of Kenyans, who were tortured and killed within the dungeons.

He noted the importance of reminding Kenyans what was before the 2010 Constitution, repeal of Section 2A and the gains the country is consequently experiencing now, by reason of political detainees and prisoners.

Waheire urged the youth in the country, to be proactive rather than being reactive in different dimensions of the political, social and economic issues, while reminding them of liberties and benefits caused by human torture.

He condemned the alleged demolition of the dungeons at the Nyayo House Chambers, terming it as a violation of the country’s history, since tempering with history will eliminate crucial evidence and facts.

Waheire advocated for the documentation of the history as some of the sources may not be conversant or reachable with time so as to conserve the country’s heritage.

‘We are here to remind Kenyans of those patriots who were tortured, maimed, killed and those alleged to have committed suicide, as well as those who were sexually abused and broken families that suffered for the sake of the freedom of this nation,’ said Waheire.

Trans Nzoia,Safaricom Partner To Digitise County Services

Trans Nzoia County has become the latest devolved unit to integrate to Safaricom’s myCounty Application platform.

Representatives from Safaricom Company, led by Rift Valley Regional Manager Mr. Charles Munyororo, signed a Memorandum of Understanding with the county administration in a colourful event presided over by Governor George Natembeya on Thursday.

Speaking at the event, Munyororo explained the key objective of the myCounty App, which is to enable devolved units to digitize all their services in one place, providing a single citizen access channel.

‘We are delighted to partner with Trans Nzoia County for the integration of all its services on the myCounty App. MyCounty provides individuals and organizations with a single, convenient point where they can access, manage, and pay for all county services. The service will be available for all 47 counties as a smartphone app, web portal, and short code and will integrate both current and upcoming services,’ remarked Munyororo.

‘Some of the key services offered by myCounty App include payment for county services, revenue management systems, a citizen reporting and engagement tool, online radio channels, updates on agriculture, health issues, utility bills, and Small and Medium Enterprises SME programmes,’ added Munyororo.

Besides county services, the application provides a ‘Sema Na Governor’ feature, which will enable Trans Nzoia residents to engage their governor or report issues.

It will further provide key county and emergency services, including requests for fire extinguishers, ambulances, police, and more, at the tap of a button.

In his address, Governor Natembeya expressed gratitude toward Safaricom, describing the giant company as one of the important local development partners that was fully supporting devolution.

‘We are delighted to have Safaricom joining us at this critical moment. Through this partnership, Trans-Nzoia residents will receive effective, easily accessible, and citizen-focused services,’ noted Natembeya, who stressed on the importance of collaborations between county governments and development partners.

NCIC Banking On Youth To Push Peace Agenda

The National Cohesion and Integration Commission (NCIC) has challenged the youth to take an active and leading role in promoting sustainable peace and stability in the country.

Deputy Director, Public Outreach, NCIC, Mr Kilian Nyambu, said young people bear the brunt of political violence, thus becoming essential actors in contributing to peacebuilding processes.

The Commission, Nyambu said, has established aggressive programs to nurture this population segment so they can be actively engaged as change-makers and peacebuilders within the community.

‘NCIC is deliberately focusing on nurturing the younger generation to confer on them the responsibility of taking charge of peacebuilding matters within their domain for a safer country,’ he stated.

Nyambu made the remarks while addressing youth representatives during the Wajibika Regional Youth Dialogue Forum, Kisumu edition, held on Thursday.

The 3-day forum targeted young people from different sectors drawn from Kisumu’s informal settlements who are more susceptible to skirmishes and turmoil.

‘Youths are potential prey for some misguided politicians who use and dump them for their selfish gain. This has resulted in the young people recording the highest number of casualties and having their opportunities destroyed,’ Nyambu stated.

He prevailed upon the non-governmental organizations and county and national government agencies involved in peace work to scale up their intervention programs by sensitizing youths to understand their role in contributing towards the realization of long-term peace and stability.

A tranquil environment, he noted, is critical to the progress and development of the community.

‘Differences in terms of opinion should not be construed as enmity. As NCIC, we encourage Kenyans to embrace one another to build a stable nation that can attract local and foreign investors for prosperity.’

President authorises construction of Gove-Chipindo-Cuvango power line

Angolan head of State João Lourenço has authorised the construction of the 220 kV electricity transmission line Gove-Chipindo-Cuvango, whose expenditure will cost more than 196 million euros.

The information, published in the Official Gazette, adds that the aforementioned power transmission line will have a length of 175 kilometers, including the respective substations, and refers to the Cassinga mining project.

The expenditure authorisation is contained in Dispatch number 99/23 of 9 May, which directs the opening of the Simplified Contracting Procedure for the implementation of the project, estimated at 196.7 million euros.

The contract will be in charge of the Turkish company Pak Yatirim Insaat Sanayi Ve Tcaret A.S, LCC, which was in charge of the project’s feasibility studies.

The Presidential Order authorises the Minister of Energy and Water, with the power to sub-delegate, to carry out decision-making acts and supervisory approval, including the preparation of procedural documents, the adjudication, celebration and signature of the contract with the Turkish company.

Minister urges young people to respect country authorities

Angolan minister of Interior Eugénio César Laborinho Friday in Luanda appealed to young people to respect the instituted authorities, avoiding insults and contempt.

Delivering his speech at the opening ceremony of the conference on “The role of youth in public security”, the minister regretted the fact that in recent times there have been some cases of disrespect against State authorities.

He quoted the example of popularization of the image and good name of public entities, as well as natural persons in terms of social networks.

In the field of public security, Eugénio César Laborinho called for the participation of all young people in social actions and strategies aimed at creating a harmonious and stable environment in the country.

“The future of our security depends on us, both national and foreign citizens, businessmen, politicians, religious, social activists and academics”, he underlined.

As for the debate on the theme of the meeting, the minister considered it a foundation for building a strong and cohesive society, based on diversity, difference and mutual respect.

In this context, he urged young people to refrain from taking justice into their own hands, as well as acts that put their physical integrity and their own lives at risk, such as the excessive use of alcohol, drugs, prostitution and feuds.

Participating in the conference on “The role of youth in public security”, secretaries of State, National Police commanders, MPs of the National Assembly and young people from youth movements.
